Flowers are fine.
But may be we should send only few calculators and backward running clocks.
Say, for example 1000 flowers and only 100 calculators and clocks.
What you say?

Now anyone can put their name in the check and encash it. If the USCIS agent is kind enough he/she would put DHS and then send for encashing...

How does that work? There is no law or process to connect an abandoned labor. I had approved labor with a PD of 1999 that got lost when I switched companies. But no one seems to be connecting that to me.
I said I was *wondering*. Not quite a declarative sentence.

Hi guys,
Just waiting for my wife to receive her SSN number with her EAD card.
How long will it take to get the registration of new company? Assuming i start it tomorrow.
Do you have to transfer the domain names, account details with web hosting company to my wife's name?
Or let them be under by name and just make the LLC under my wife's name and let her run the show?
All the accounts that are responsible to make/receive payments should be under my wife's name or just be under this new LLC name?
Thanks
sri

eb2 china was at jan2006 for a while. this will be the first time that they will be moving beyond jan 2006.
The movement EB-2 china gets some times is solely because of the visa number that category gets. This typically happens in the first Q. EB2-I and EB2-C will have different PD's . Some time in 2nd Q or mid 2nd Q, both I and C will have used up their quota and they will continue to have the same PD until the end of the fiscal year as PD is the only thing that matters.

My Message:
Hon. Mr. Gonzalez,
I would like to register my protest with you for not following an orderly method when approving I-485 applications. In the last two months, while the priority dates were current for several applicants from India in the EB2 category, most applications with later priority dates and later receipt dates were approved by USICS, causing deep concern and grief among those waiting patiently in the line before them.
This significantly reduces our confidence in the system. Thus, I am sending you this letter with a book as a symbol of protest and with the hope that USCIS will deal fairly with all the applicants as per the rules and regulations.
Thanks

Singhsa3,
I believe Gonzalez resigned from the director of USCIS effective April 18,2008. We should be instead sending the letter to following:
Jonathan Scharfen, Acting Director, USCIS
Michael Aytes, Acting Deputy Director, USCIS
Pls correct me if I'm wrong.

But I think franklin posted earlier that she got her GC when the priority dates are not current. And shows about 5 EB3s from India got approvals during September whos PDs are on or after 2003.Do you think USCIS might have requested the visa number for their cases when their PD was current?

U r a senior member and asking this question? Anyways...here's some of the points I think that are candidates for Red/Green:
Candidates for Red:
1. Using third class language
2. Unnecessary and stupid arguments
3. Narrow minded comments
4. Immature thinking
Candidates for Green:
1. Valid and logical thought process
2. No foul language whatsoever
3. Politeness
4. Likable comments
What's hyappening with ssnd's comments is...instead of getting red for all of his filthy comments, somebody is giving him green. God bless IV.
Dude, I asked where do you go and rate the post. No wonder ssnd calls you dumb.

We pay tons of fees to USCIS and wait for more than six years for GC and yet some shitty senator who does not know anything about immigration comes and rattles on stage.
The hearing should have started with the Ombudsman reports as a basis. Then the hearing should have asked USCIS for solid data like -
How many applicants from year 2001-2007 are pending? In what year, category, country? (to show the trends of backlogs)
How much percentage of applications were processed on annual basis compared to the limit? What is the inflow and the outflow?
What are the customer satisfaction levels for USCIS?

Please contact me, PM or post, if you are willing to be interviewed for a news story on this. You should be a professional in the San Jose / Bay area, although anyone in California should contact me. I will forward your information to the reporter.
On a related note, I have gone through the laws and regulations and the SSA is required to provide SSN for valid non-work purposes. I have compiled an extensive argument to support this case and I am currently in the process of getting the SSA to recognize the stimulus payment as a valid reason as required by the Social Security Act. If my petition is successful, it will set a precedent for others affected by the ITIN rule.
Also, you are not a nonresident if you live in the USA. According to one of the replies I received from the SSA.
"Under the IRC, therefore, an alien who is a nonresident for immigration purposes (i.e., not admitted for permanent residence) may be treated as a resident for tax purposes, if he meets the substantial presence test. Therefore, he could be eligible for the tax credit. However, he may not be eligible for a SSN if he wants one solely for the tax credit."
I disagree with the last sentence and I am currently beginning the appeals process. I am willing to share the regulations and laws that support my case but I am wondering how to best share this information with others who may also want to get involved.

An EB3 ended up doing a part-time Masters in the US and then is eligible for a job that qualifies under EB2?
Point is, let us stop playing permutation politics and focus on what matters most... but I guess it is hard to ask folks to forget their inborn / bred selfish nature and myopic world views...

Some good ideas and thoughts here. Here's my 2c :)
One thing that no one has pointed out and I wonder if people even care about it, but to me its a BIG issue.
All our hard earned $$$$ going into the Social Security and Medicare pool. Has anyone even thought about this ? If you look at your figure closely, it is the amount of money that an average american family saves over 1 year.
I personally feel that it is too big a contribution to let it to waste and for me getting a green card would make me eligible to get all the benefits that I deserve and have rightly earned.
Peace

as per this document, you can port to yourself. (Question #8)
But below are the reasons why I am backing off of opening an LLC on spouse name and porting to that.

"This suggests, fairly clearly, that any communication to the USCIS per the Cronin Memo that the adjustment applicant intends to become self-employed is likely to trigger an RFE to inquire into the legitimacy of this arrangement. Legitimacy in this context is likely to be gauged by the concrete steps the beneficiary has taken in furtherance of the self-employment arrangement, understanding that only full-time and permanent employment will suffice for immigration purposes. Such steps would include the completion of legal and corporate formalities, the securing of financing, the purchase or lease of business premises and equipment, the development of a detailed business plan, the hiring of employees, and any other measures typically taken in the establishment of a business. Vague aspirational statements, however ambitious, about future plans to develop a business are unlikely, in the absence of tangible proof, to be accepted as probative of the requisite legitimacy of the self-employer and job offer."
Also, one relevant footnote in the document -
"At the AILA National Conference in 2003, a USCIS officer indicated that an attempt to invoke 106(c) in a selfemployment context is likely to raise a big red flag for an adjudicator, and that self-employment may be viewed as an easy alternative for aliens who are unable to find employment to sustain their adjustment-of-status applications. Schorr & Yale-Loehr, supra note 2, at 499. It should also be noted that the Memos view the possibility of an adjustment applicant becoming a public charge (and thus being inadmissible under INA 212(a)(4)) as being a relevant inquiry and that an RFE requesting information about a self-employment arrangement is likely to probe whether or not the applicant has sufficient financial resources to avoid becoming such a public charge."
Question #3 and #4 should conclude this discussion.
Also how do you define an established company.
If I stay employed for 2-3 yrs on my spouse's LLC and bring 200K each year, is that established?
