Nothing unusual...infact just a tiny tip of an iceberg. Family based immigration including marriage constitute close to 85-90% of US new immigrants. Other avenues being tightened in recent years, we are sure to see more and more. In fact in recent years I have seen many H1Bs/F1 marrying USC.
For every case being busted, there are many many undetected cases. It is called legal arbitrage, with other areas being tightened amd under attack and marriage based being relatively untouched, it is a matter of time that one will increase.

Hi Guys-
I am on H1B, working in US. I got my status changed from F1 to H1B last yr and never got it stamped ever since. I am going to get married next month in India and would require a visa stamp on my passport. I believe it is a straight forward process but would appreciate your experiences and suggestions for this.
1. I am planning to take visa appointments both for myself and my future wife togther at the Delhi consulate (ofcourse by paying separate fee). Can I do that here in US for both of us?
2. Once I get an appointment, we both should appear togther for the interview (for my H1B and her H4) . Right?
3. The forms 156 and 157 are required to be filled during the interview but not while taking appointments. Is it right?
3. I will take all my docs. along with our marriage certificate, and pictures from wedding. Do I need something extra to that?
Please suggest me any other important thing which I should be aware of in this process.

Hello, I really appreciate a lot if anyone here could help me on this..
The company I have been working with an H1B for a years got recently restructured to a new firm and it filed a H1B transfer for me this Feb. The petition got an RFE and the firm made an Appeal, which is now pending. The job looks now rather unsecure and I am not sure if the company will continue sponsoring me for a new H1B if this transfer got denied in the worst case scenario..
So my questions are:
1. Can I file a COS to F-1 while my H1B transfer appeal is still pending?
2. If my H1B transfer appeal got rejected, or I got laid off while it's still pending, after that happened is it still possible and in time to file a COS to F1?
I am really worried about my current situation now, and thank you very much if you could kindly help on it!

I am generally a lurker in this website. Based on the other threads, I came to the reality there is no way I am getting my GC for another 4-5 years or may be even longer.
However, the USCIS site has a status "Card/Document production". The last status update date was 6/25/2010. The only update I could think of is my new address around the same time. I went to the USCIS status website after 2 years out of curious, after I got back from giving my finger prints (3rd since I485 filing) today.
Is the USCIS jerking me off? :rolleyes:

Your passport has nothing to do with you invoking AC21. AC21 is just a way of informing Uscis that you are switching to another job with similar duties, that's all. There's no official form or application to submit.
Just apply for the renewal of your passport as you would usually do. That's all.

Every day, a small Texas company compiles the reports and sells them to lobbyists, lawyers and others who pay thousands of dollars for a peek at the reports and what they say about the congressional agenda. And it's all legal.
"How I get them is my trade secret . . . but I get them all," said Walt Seager, who digs up the reports for Gallery Watch, a legislative tracking service.
The Congressional Research Service (CRS) was established in 1914 as Congress's supplier of nonpartisan research and analysis. Its reports are neither classified nor copyrighted, but they've long been the exclusive property of lawmakers, who distribute them as they see fit. Taxpayers supply the agency's $100 million annual budget, inspiring open-government groups and some lawmakers, including Sens. John McCain (R-Ariz.) and Patrick J. Leahy (D-Vt.) to push for public release of CRS reports.
Aftergood and others have fought back by posting every CRS report they can find on their Web sites. But watchdog groups have released only about 10 percent of the total, not enough to reveal the patterns that suggest what Congress might do next.
Subscribers to Gallery Watch pay about $4,000 a year to get all the CRS reports, online and searchable, delivered weekly.

Those of you who have been reading this blog awhile will recall the many posts I've written regarding major problems in the system of detention for immigrants facing potential deportation. Nina Bernstein of the New York Times reports this morning that the White House will enact a series of reforms designed to curb abuses. I am wondering how do I help / sponsor to obtain US tourist visa (B2) for my young (say below 10 years) niece and nephew in India. Their parents (my brother and his wife) will not travel with them so they do not need a visa.

HI,
I am in US and have changed a job recently (changed status from L1 to H1 while in US). I plan to travel to india soon in Feb 2010. My passport is valid till March 2011 and my H1b approval is till 2012. Will this be a problem for me when I go for stamping in India.

It will not be "a problem"; but they will stamp your passport only till the exp date of passport (March 2011) and your I 94 (that you will get upon returning) will also be valid till March 2011 as well.

1500 H-1Bs were claimed in the last week and just over 20,000 remain for the fiscal year. Based on a four week rolling average (1175), I am projecting the target will be exhausted in 17 weeks which will be February 23, 2011. Previously, I had been projecting March, but the overall usage of H-1Bs has been somewhat busier in the last month than in previous months. The masters cap usage this past week was 500 and the monthly average is 450. There are 3,800 H-1Bs left of 20,000 and I am projecting that cap will be exhausted in late December,...

I'm glad to see Immigration Voice weighing in on this one. Under some of the versions of health care reform proposals being considered by Congress, legal immigrants could be excluded for five years before they can access the Medicaid and insurance subsidies despite the fact that they pay taxes, are abiding by all of our laws and are often making critical contributions to the success of this country.
