Hello,

Need advise since I'm planning to get my H1 B stamped... On my 2nd visit on B1 Visa (Business) in 2005 I got an offer to complete my master's degree(sponsorship). I applied for a change of status and was approved. I completed my master's degree and filed for OPT which got approved and finally H1. I'm currently working for more than a year on H1 B visa. I was planning to get stamping done at Hyderabad, India.

Is it safe enough to get the visa stamped? And, do I need to take any additional documents to ensure that the visa gets stamped.... Please advise....

Hi ,
I am going to tgransfer my H1 b with new employer .
My employer is going for normal processing and I asked him for premium processing as my project is going to end by Aug 2009 . Then My employer informed me that there are lot of RFEs for premium processing . Is it true ?
Please suggest whether I should go for premium or not ?

My lawyer filed my I-140 application in nebraska service center. Is that correct? shouldn't it be Texas Service Center for Florida. Does it matter which service center to apply to?

The Senator Chuck Schumer (D-NY), the Immigration Subcommittee Chairman, told the AP yesterday that he plans on introducing a comprehensive immigration reform bill before Labor Day and then hopes to have a debate on the bill in the fall. Schumer hinted that advocates for highly skilled immigrants are likely to be happier with the bill than those pushing for guest worker reforms for lesser skilled workers and that business and the unions have yet to reach a compromise. My H1B was refused under section 221(g) (petitioner is not able or willing to provide employment....) and case has reached USCIS for review. The lawyers however are asking me to travel on H4 and then convert to H1 in US and they say this can be done in 2 weeks. I am so very skeptical about this! How is this even possible?
Their response is that i have an H1B from earlier quota, so i can get a new petition filed and start working on it once its approved.How come people dont do this if its valid?
My questions if anybody can help me are
1) Can i go on H4 visa without revoking my H1B petition which is under review with USCIS? Or will consulate ask me to revoke my H1B petition?
2) If i go on H4, can i really get a COS to H1 in US i.e. not the April 2011 quota but in the already assigned quota and i can start working within a few days of approval?

I filed my eEAD 45 days back, competed finger printing 15 days back, still I don't see LUD on my case; However, my spouse who filed 30 days back had 3 LUD, and a recent after finger print.

Can guys suggest, is this common. Usually after FP I should see a LUD, right? What are my options..:confused:

i got married with my husband right before he filed his i-485, so we can file it together. His i-485 recently got approved, mine is still pending since March 2007. After speaking with IO, I found out that my name check is pending. My name is not common, I had no interaction with a law agencies in any way. So, I suspect that name check is just an excuse.
My question is, can my marriage to my husband just before i-485 filing be a reason I am still waiting? Has anybody experienced something like this? I'm not from a country where arranged marriages are common practice and we have a child together.

Hi Immigration Voice Team,

I would like to know your advice,

My details are

- EB3 / Labor filed and approved during July/2007
- I140 & I485 filed concurrently during August/2007
- I140 got approved on Jan/16/2009
- EAD Renewal is made and existing one is valid till Nov/2010

I have only labor number, 140 approval notice with me. where as I do not have labor complete job description.

As of now

- Can I change my employer without any labor job description?
- Does my employer has still rights to revoke I140?
- How can I change job to new employer and protect myself from I140 revoke by existing employer?
- GC filing expenses was completely bared by employer only.

Hi Gurus,

I was wondering if anyone on this site has ever filed an EB2-NIW I-140 petition ? And if so, what fields have you filed it in ? Do you necessarily need a masters degree or would 10+ years of experience in systems development qualify ?

I was also wondering if working in the health-care technology field, to create systems to diagnose and monitor cardiovascular systems to detect/prevent heart diseases would be something that could considered in the "national interest" ? If there is a job offer already extended to someone to work on such projects, would you still need a labor certification ?
