    Democrats Again Look to Change GOP Motions; After Defeats, Leaders Studying Ways to Neuter Republicans' Motions to Recommit (http://www.rollcall.com/issues/53_52/news/20763-1.html) By Jennifer Yachnin | ROLL CALL STAFF, October 31, 2007

    Exasperated over Republicans' continued efforts - and occasional success - in thwarting the House floor schedule, Democratic leaders acknowledged Tuesday they are reviewing the chamber's rules to determine how to curb the minority's ability to put up roadblocks at critical moments in the legislative process.

    House Rules Chairwoman Louise Slaughter (D) said the committee's Democrats have begun meeting with both current and former Parliamentarians to discuss the chamber's rules and potential changes.

    The New York lawmaker said those discussions have focused in part on the motion to recommit - one of the few procedural items in the minority party's toolbox that allows them to offer legislative alternatives when a bill hits the floor, and that Republicans have used to force difficult votes on Democrats or prompted legislation to be pulled from the floor - as well as other procedures, which she declined to detail.

    Slaughter said no timeline exists for the review or potential alterations, however. "Nothing is imminent. We want to take our time and do it right," she said.

    But one Democratic lawmaker, who asked not to be identified, said the majority is considering neutering the motion-to-recommit process and converting it to little more than a last-chance amendment for the minority party.

    Under current House rules, the minority's motion can effectively shelve legislation through minor alterations to the language of their motion - specifically designating for a bill to be returned to its committee "promptly," rather than the usual "forthwith."

    Republican leaders have used that strategy to force Democrats to either vote against measures they would otherwise support or vote to kill their own bill. Earlier this month, the GOP used that procedure to target a bill governing federal wiretapping and surveillance programs, prompting Democrats to scrub an expected vote.

    Another Democratic lawmaker, who also is familiar with discussions and asked not to be identified because of the sensitive nature of those conversations, said that is only one option under consideration.

    "We don't want to limit the minority's ability to have legitimate motions to recommit," the Democrat said.

    House Majority Leader Steny Hoyer (D-Md.) railed against Republicans' use of that particular tactic at his weekly press conference Tuesday, echoing complaints Democrats have raised off-and-on since March.

    "The Republicans continue to use the motion to recommit for political purposes, not substantive purposes. Substantive purposes would be trying to change policy. For the most part, what they do with their motions to recommit are not change policy, but try to construct difficult political votes for Members," Hoyer said. "We understand that. To some degree, we did that as well. So it is not surprising."

    While Hoyer acknowledged that Democrats had at times employed the same approach in the past, he criticized Republicans for using the method 22 times thus far in the 110th Congress, asserting that Democrats used the tactic only four times between 1995 and 1998.

    "This is a game. It is a relatively cynical game," Hoyer added. "That doesn't mean it is not an effective game and causes questions. So we are trying to deal with that."

    Democrats earlier had sought to alter the House rules on motions to recommit in May - an unusual step, given that the chamber's rules are rarely reopened mid-session - but Republicans rebelled on the House floor, and Democratic leaders agreed to forgo the changes, at least temporarily.

    Democratic leaders suggested in August that they planned to offer legislation on the House floor aimed at dissuading Republicans from offering contentious procedural amendments tied to such hot-button issues as immigration. At the same time, Democrats hoped to provide insulation to their own Members with a separate vote on those topics, but have yet to produce any such resolutions.

    Republicans have succeeded in winning 21 motions to recommit - the majority of which would not shelve the legislation they amend - in the past 10 months, a point that President Bush praised in a Tuesday meeting at the White House with Minority Leader John Boehner (R-Ohio) and Minority Whip Roy Blunt (R-Mo.), according to a GOP aide.

    "Republicans and Democrats alike have lived under the very same germaneness rules since 1822, and changing them won't solve the majority's inherent inability to govern," Boehner spokesman Brian Kennedy said. "This isn't a question of rules, it's one of competence."

    Microsoft XNA is a popular framework applied with C# that is being used to create quality games. My thesis group decided to use the said framework for our thesis which required us to develop a game. The game automatically logs the actions that the players perform while playing. The data that will be gathered is to be used for our research which is mainly about player modeling. It would really help us in our thesis if you'd play the game. Thank you!

    My wife came to the US on a H4. She got her H1 approval in October 07 and started working for the consulting firm that sponsered the H1. She also got a consulting position in a company. But her SSN was not issued until Jan 08. So the consulting company cannot gerenate payroll for Oct, Nov and Dec of 2007. We are planning to goto India in May and also get our Visas stamped. Any ideas on whether we will run into problems when we go for stamping, since she will not have a W2 for 07. Also will the paystubs from 2008 suffice at the consulate? Do we have to tell the consulate that she started working in Oct 07 or can we just say she started in Jan 08 will this create a problem of why did she not strat working as soon as her petition was approved in 07.

    Well, if you leave your co. now and also want your GC then:

    Your H1 period will be over after 6 years irrespective of the I-140 from the old co.

    GC: You do have to start from scratch.
    However, you can still maintain your PD if your prev. co does not revoke the I-140. The documentation of your Old PD is to be attached with the New I-140.

    I think i had put my question in the wrong section before...

    If anyone had similar requirements ,I would really appreciate your views on this.

    My Company says that the Minimum Job requirement for the my JOB is
    5 years of progressive exp in developing applications in JAVA
    and there in 2 years of experience in mobile systems.

    I have 6 years of progressive experience in Java, and 4 years in mobile systems. Do you anticipate any issues with an EB2 approval.

    I always thought eb2 is ms/bs+ 5 years of progressive, i never know it could be bs + 5 years in core skills and 2 years in others.

    When you travel on AP carry both the copies. On the PoE the IO will keep one and give the second to you after it is stamped. You use the returned/stamped Copy for your future travel

    When one applies for AP in Multiple entry category they will be given 2 AP dox. lets say if one has used both on travelling like both has stamp of POE can they reuse the same for future travel with in the one year period of validity ?

    WASHINGTON -- Congress returns today to face a pile of unfinished work, little time and many White House veto threats. With the budget process at risk of collapsing for the second time in as many years, there is a sense that lawmakers are back to where they started after the 2006 election: divided by Iraq but chasing the dream of a political center from which to govern.

    The best shot for Democrats is to find that center and build coalitions with moderate Republicans to complete Congress's agenda before the holidays. But the bitter divisions with President Bush over the Iraq war make that more difficult.

    "The more they take Bush to the woodshed on Iraq, the more difficult it is to bring over moderate Republicans," says Neil Newhouse, a Republican pollster.

    Compounding the problem are the moods swings and often combative nature of the Democratic leadership. Republicans tend to march four abreast, even if it means heading off a political cliff as in the 1995 government shutdown; Democrats resemble a family packed into a station wagon and yelling different directions at the driver.

    House Appropriations Committee Chairman David Obey (D., Wis.) is highly respected but can hurl insults and convey distrust even as he looks for compromise. "Against my better judgment, I am going to assume you will have good faith," he said of budget talks with Republicans. If there's not good faith? "It's not going to be pretty," Mr. Obey promises.

    Democrats, as the party charged with running Congress, would pay the heaviest price for stalemate. But Republicans aren't insulated from blame, especially if they are seen as walking away from compromises important to voters.

    The tensions reflect the twin legacies of the 2006 elections. Antiwar sentiment helped bring Democrats back to power while independent voters wanted an end to gridlock in Washington.

    Recent votes suggest a bipartisan consensus may be emerging. The passage of an energy bill with tougher fuel standards for cars appeals to independent voters. (See related article on page B1).

    In the mid-'90s, when Newt Gingrich's "Republican Revolution" collided with then-President Clinton, he never got more that 240 votes in early skirmishes over defense- and appropriations-bill vetoes. Current Speaker Nancy Pelosi has averaged 275 votes, thanks to Republican support for her efforts to expand child-care and education funding.

    This month's deadlines will sorely test the new majority. A stop-gap spending bill to keep the government operating expires Dec. 14. Middle-class households counting on tax refunds don't want to go into the New Year without protections from the alternative minimum tax. And the Pentagon says it will send out furlough notices before Christmas for thousands of civilian employees unless it gets more war money.

    Trying to avoid a collapse in the budget process, Democrats are trimming $10.6 billion from prior House and Senate spending bills, which will be packaged into a single omnibus package approaching $490 billion in discretionary appropriations.

    Most domestic accounts will be held to 3% increases over 2007 levels. Significant new money is preserved for veterans' medical care as well as $3 billion in emergency funds for border security, both bipartisan priorities. And after falling two votes short of overriding Mr. Bush's veto, a $150.8 billion labor, education and medical- research budget would be reduced by $3.6 billion.

    Other major issues include:

    Health Care

    The spending talks parallel efforts to win passage of a $35 billion, five-year expansion of the State Children's Health Insurance Program. Democrats will move to extend the program with additional funds to guard against state shortfalls at least through 2008. Republicans are seeking a line barring federal aid for any household whose gross income exceeds 300% of poverty or about $41,000 for a single parent and child. Democrats have agreed to such a cap for SCHIP but will want more concessions from moderates before extending the same requirement to much of Medicaid, the larger state-federal health-care program for the poor and disabled.

    Farming

    With winter wheat planted and farmers seeking operating loans for next year's crops, there is growing anxiety at the pace of the farm bill, which has stalled in the Senate. Some type of extension may be needed, but Chuck Connor, the acting Agriculture secretary, says "there is still time to get this done."

    The threshold test could be whether lawmakers embrace the administration's goal of barring subsidies to any farmer with adjusted gross income above $200,000. "That would be an important signal," said Mr. Connor, suggesting that the administration would be more willing then to show some flexibility about Congress's demands.
