Guys I will be going for my first H1 visa stamping in New Delhi. I am currently in the US. I transfered from F1 to H1. Have been looking into documents to take to the interview, and looking at so many 221(g) cases, have been confused by this term "unemployment wage report". I would really appreciate it very much if someone could please tell me what is "unemployment wage report" and how is different then "prevailing wage report"? Also, do I need to take both of them to the visa interview? Thanks!

I graduated in Dec 2008 from USA and then returned back India. My F1 visa is valid till dec 2011 and am planning to come back USA for pursuing my phd. I got I20 from a different university. Do I need to attend for f1 visa stamping again ? . Please help .

For every case being busted, there are many many undetected cases. It is called legal arbitrage, with other areas being tightened amd under attack and marriage based being relatively untouched, it is a matter of time that one will increase.

Can USCIS be sued for picking files in random ( the only time they budge is when a federal judge put an order ).

Organize a group to initiate a letter writing campaign to Congress. Write to your own Congressman, your two Senators, and the chairs of the Senate (Kennedy) and House (Loftgren) immigration sub-committees. Get the facts straight and offer as much emprical evidence as possible. If Congress were to receive 100,000 such letters, they would definitely do something about this problem.

Hi,
Currently I am working for employer A on H1B. I have applied for I-485 and have EAD. I have one permanent opprtunity from a consulting firms B. Compnay B is asking me to join on EAD. But threir current client is in Canada. So compnay B want me to travel to Canada, every week, retun back to US in week end. Can I do this while working on EAD. I am just worried wether it will cause any problem. They told that that is the reason they do not want to do H1B.

I am currently on H1B and in the process of leaving my current employer XYZ Inc. I also have an EAD that I haven't used yet but plan to use going forward. I understand that XYZ will and is rather obligated to notify USCIS of termination of my H1B employment by virtue of which, USICS will take steps to revoke the H1B petition. That being said,
1. Will I (beneficiary) and / or XYZ (petitioner) will receive a notice saying my H1B petition has been revoked?
2. Will it help in any shape or form if I were to fill an (back dated) I-9 form with XYZ indicating that I was already on EAD with XYZ before my termination? In this case, is XYZ still obligated to notify USCIS of termination of my H1B employment?
3. What constitutes a "bona fide termination" and is this even applicable in my case? Should I have a formal resignation letter in place for audit / RFE purposes down the road, if any?

I came to USA on on L1 Visa in 2003/March and I was on same visa till Dec/2003. ( 9 months).
In 2004 Jan I filed H1-B and my status changed from L1 to H1-B. Again I filed 2nd extension (for next 3 years) on this H1-B and I got this approval upto given till 2010 Jan.
My question here is can I wait upto current H1 - B approval validity even though total stay on L1 + H1-B is exceeding the 6 yrs ?
OR do I need apply for H1-B extension on my approved I-140 (curently in 485 stage of my GC) to get 3 more years extension as 2010 Jan will be my 7th year in USA ?

during this time Company "B" apply for H-1B Transfer(without paystubs as they plan to submit later in a week or so)
Company "A" did the settlement and issues paystubs etc... but same time they apply cancellation of H1.
My I-94 is valid untill dec-09
Can a transfer be done like this???
Please advise as i am dying day and night.............do not make a fun of it.

Supposed my I-485 was approved, am I legally required to go to USCIS, surrender my I-94 card and get a I-551 stamp? Could I just wait for GC to come in the mail?
The card is taking just a few days to arrive these days. Just wait for a few more days. You need the I-485 approval notice to get I-551 stamp.

I have an H1B approval from USCIS, and I am trying to go to Canada for the initial visa stamping. But then i have a problem. I initially entered the country as a visitor, and married a citizen, but only after my I-94 had expired for about a week. (My petition is still pending. The company I am working for could not wait for my greencard, since its already been years since I started that process, so they went ahead and applied for the H1B visa for me). I heard that it is a problem to do the visa stamping in Canada if you have been out of status before. Is it advisable to go to Canada for the visa stamping?

So this may be the last week of H1B visa filings, as of November 27, 2009, approximately 58,900 H-1B cap-subject petitions had been filed. USCIS has approved sufficient H-1B petitions for aliens with advanced degrees to meet the exemption of 20,000 from the fiscal year 2010 cap. Any H-1B petitions filed on behalf of an alien with an advanced degree will now count toward the general H-1B cap of 65,000. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn.

I need to get my H1B stamped in Mexico. I know there are some agencies which offer a complete package trip to the Mexico US Consulate. Does anybody know some names and contact information?
I am based in Los Angeles and am pretty close to Mexico border. Do they have something in Southern California? Other places are also Ok.

I'm on OPT since Feb 14 2011. This is my first 12 months of the OPT. I recieved an OPT card from USCIS but I'm not sure what is my valid I-20 at this moment ? Is it the one saying that "OPT is requested" ? I filed a bunch of papers during OPT application but whatever reason my International officer never wants to explain anything to us students and I've to search everything on the internet. I'm applying for a driver's license test and want to know what I-20 would be needed.
Also, my employer is willing to file my H1-B. Should I tell him to file it this year or the next year ? They also signed up for everify recently.
Please suggest.
