My H1-B visa ended on December 31, 2009. I applied for a change of status to F1 visa on December 21st, 2009 towards the Spring 2010 (Jan 2010) semester. I received an RFE stating that I need to send a new I-20 for a valid future semester.
Assuming this new I-20 is for Summer 2010 (May 2010), my question is as follows - If my change of status to F1 gets approved and my semester starts 2 months later, am I allowed to legally stay in the country?

I left the U.S on October 30 2009. My L.C. [Perm] had been filed on July 30 2009 and was recently approved.
My 6 year H1B expired on Feb 2 2010, with approximately 160 days available for recapture.
My company needs me to return to the US urgently and is wanting me to apply for a Business Visa.
Subsequently when I am in the U.S, they intend to file for I140 and then 7th year H1B
extension plus recapture time based on pending I140
Is this feasible? -- What impact would it have on my green card application process?

The New York Times reports that tomorrow Immigration and Customs Enforcement will be sending instructions to agents in field offices aimed at changing their enforcement focus from work site raids that largely resulted in mass arrests of workers to I-9 audits and undercover investigations mainly targeting employers. However, workers will still be subject to arrest. According to the Times, the guidelines are partly a response to ICE's blindsiding DHS Secretary Napolitano with an unauthorized raid on a Bellingham, Washington mechanic's shop, which I discussed here.

it may be possibal, but thats really pushing the limit of flash. I whoudnt reccomend trying it, but thats kinda up to you. You shouldnt even think about it unless your an expert at actionscripts..

I am starting this thread for the people who are Greencard Holders and not married. Please share some thoughts for bringing their spouse here.
IV can help in this matter.
If all visa holders and citizens can bring their spouse instantly then why GC holder have to wait for many years after getting GC after many years.

I sent my completed package to the lawyer 2 weeks back, and I have not heard back from him.
The initial draft needs to be sent back by the lawyer for signatures and then the file can go out.

sounds like your lawyer is getting 'instructions' from your company. I would just try to talk to your employer and work out a solution.

I received the excellent news today that the Memphis Youth Symphony Program has landed Bulgarian-born Stilian Kirov as it's new Music Director and Conductor. And since one of my children performs with the MSYP, the news is even better. Kirov is a graduate of the Julliard School of Music and has conducted major orchestras across Europe and the United States. Stilian is also an accomplished pianist. In 2001, he was awarded a gold medal in Paris' Claude Kahn International Piano Competition. We look forward to Maestro Kirov coming down Memphis way.

I am working for a consultancy company at direct client location. My client has filed a H1B transfer petition for me with job title as Lead Business Analyst. My current job title with consulting company is programmer analyst. My question is that if I go for visa stamping with new employer�s I797, will I have any issues in visa stamping if they see the change in job title from programmer analyst (consulting company) to Lead Business Analyst (Full time)?

I went on March 11. I went in for 10 am appointment and was out at 10.10 am. Fulltime, first time H1B stamping. Simple questions - where did I do my education, what do I do in my current job, then the officer asked for W-2s from last two years and that was it.

1. Does it really matter what date the 485 application was filed, if it was filed within the specified time-period ?
I mean, will it matter if someone applied for 485 on July 30th or August 17th, other than trying for an EAD and AP earlier ?
2. Is there a benefit of applying early in the timeframe, in getting an approved 485 ?
Please respond at your convenience.
