From Metro Weekly: Following up on reports from this weekend, Metro Weekly just received confirmation from Christopher Bentley, the spokesman for the U.S. Citizenship and Immigration Services, that cases of foreign partners who are married to a same-sex partner and would otherwise be eligible for a green card are on hold in light of questions about the continued validity of the Defense of Marriage Act. Based on USCIS's last action rule, the status of an applicant depends on whatever petition is approved last. So, if her H4 is approved after her H1 COS, then she will be on H4.

I am assuming you have applied for H1/H4 extension recently in regular processing. So the chances of her H1 COS getting approved first under premium are higher. So once you get her H1 COS approval, just withdraw her H4 petition.

Do we (parent) gets any benefits in terms of Visa status if you have child born in USA and you stay in US for certain years?

In the other word:
Once you have child born in USA is there any way to get green card based on your child citizenship?

I did it through an attorney and captured about 5 months.

They did a photo copy of my entry/exit dates in the Passport and copy of all my previous I94 cards. Along with that they sent in a Letter asking USCIS for the recapture.

It was a H1 transfer and recapture at the same time. I got approved for 17 months ( 1 Year + 5months recapture). at that time, I was over 6 years without I140 approved.

Per old instructions everyone was sending to Nebraska, and new instructions published are for 'direct filing'.

Do I follow direct filing rule or Nebraska only rule?

I am finally ready with medicals and photos and will be sending packet tomorrow.

I am a July' 07 I-485 filer and have received my EAD and AP.

I am currently on H1 and not using my EAD yet.

In my situation can I accept any contract work on 1099? This will be beside my full time work.

Do I have to switch to EAD from H1 to accept 1099 for contract work?

I believe you have to switch to an EAD if you want to engage in some work on the side.

My lawyer selected option "a" in section 2 of I-485 for I-140/I-485 filed concurrently. Some members are saying that their lawyer selected option "h". Can some one tell me what must be the correct option for concurrent filing? If option h is correct, Is it possible to amend the existing petition?

My reciept notices show the right date in August.

Hi, I am in 8th year of H1b with 140 approved (EB3) from company A. I would like to switch to company B and planning to start EB2 quickly to enage a new interesting project . I have following questions related to the same and early advice from you all would be highly appreciated as am running out of time in engaging the new project.

1. Can I do H1 transfer from company A to company B using A's 140 approval after my 6 years of original h1b quota. I am currently on 8th year of h1b.

2. Can I able to port the priority date from company A's EB3 filing with the new EB2 filing from company B?

3. If company A cancels the 140, still can I able to port the PD ?
